In order to be commercialized within the European Economic Area, appliances burning gaseous fuel, and their safety, control and regulation devices must comply with the technical criteria compiled in Regulation EU 2016/426; the manufacturer of the device or equipment, or its authorized representatives, is responsible for ensuring that they have been designed and manufactured in compliance with the requirements laid out in Annex I of the regulation.
The manufacturer is responsible for issuing the EU Declaration of Conformity and placing the CE Mark on the product. This ensures the free flow of products within the European Market. The commercialization of certain appliances that use gaseous fuel, and their safety, control and regulation devices requires a notified body like AENOR, with code 0099, to certify compliance with the mandatory safety requirements laid out in the regulation.
AENOR is authorized by the Ministry of Industry, Trade and Tourism as a Notified Body, and is accredited by the Spanish Accreditation Body (ENAC) for this certification.
The applicable Regulation (EU) 2016/426 on appliances burning gaseous fuels fully came into force on 21 April 2018, repealing Directive 2009/142/EC.
The Regulation applies to appliances that burn gaseous fuels and are used for cooking, refrigeration, air conditioning, heating, hot water production, lighting, or washing, as well as blown air burners and heating bodies equipped with such burners.
It is also applicable to safety, control, and regulation devices and their sub-assemblies, intended for incorporation into an apparatus or to be assembled to constitute an apparatus.
The conformity assessment is carried out by way of a system of Modules set out in Regulation EU 2016/426.
The applicable modules apply both to the design phase, with the EC type examination defined in Module B, and the production phase, for which there are different possibilities, as specified in Modules: C2, D, E, F and G.
Production surveillance audits for modules based on quality assurance systems can be integrated into ISO 9001 quality management system audits
